Terms of Service

By accessing or using ArtDeck ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. By creating an account you represent that you meet this requirement.
2. Your Account
You are responsible for maintaining the security of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use.
The Service offers two kinds of accounts. A collector account lets you browse, follow artists, save works to your deck, and send inquiries. An artist account additionally lets you publish a public artist page, list works, and appear on the map. By upgrading to an artist account you represent that you are the artist (or an authorized representative of the artist) whose work you publish.
3. Acceptable Use
You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service. You may not attempt to gain unauthorized access to any part of the Service.
In addition, you agree not to:
- Use location information shown on the map to harass, stalk, or otherwise harm any artist, or visit a studio location uninvited where the artist has not offered visits;
- Send inquiries that are spam, solicitations unrelated to the artist's work, or otherwise abusive — inquiry and messaging features are rate-limited and monitored for abuse;
- Scrape, harvest, or bulk-download artist locations, contact details, images, or other content from the Service;
- List works you did not create or do not have the right to sell, or misrepresent the price, availability, authenticity, or authorship of any work;
- Manipulate follows, featuring, or discovery placement through fake accounts or automated activity.
4. Your Content
You retain ownership of content you submit to the Service, including artwork images, profile text, deck notes, and inquiry messages. By submitting content you grant us a worldwide, royalty-free license to host, store, reproduce, resize, and display that content in connection with providing the Service. This includes generating thumbnails and other image derivatives, displaying your content in search and discovery surfaces (such as the map, the artists index, feeds, and the landing page), producing link previews when your pages are shared, and allowing search engines to index your public pages.
If your work or profile is selected for featuring, we may display it on the landing page and other promotional surfaces within the Service. You can unpublish content at any time, and the license ends when the content is removed, except for cached or shared copies already in transit (for example, link previews on third-party platforms).
We may remove content that violates these Terms or that we reasonably believe is unlawful, infringing, or harmful.
5. Artist Listings and the Map
Artists choose whether and how precisely their studio location appears on the public map — at an exact pin, neighborhood, or city level. Whatever precision you choose, that location is published publicly and visible to anyone, including without an account. Do not publish a location you are not comfortable making public; if you work from home, consider neighborhood or city precision.
Artists are responsible for the accuracy of their listings, including titles, mediums, dimensions, pricing, and availability status (such as available, sold, or commission-only). Keep statuses current so collectors are not misled.
6. Purchases, Commissions, and Inquiries
ArtDeck is a discovery platform, not a marketplace. We do not process payments, take commissions on sales, hold funds, or act as a party, agent, or broker in any transaction. When you send an inquiry — whether about a purchase, a commission, or a general question — we relay your message to the artist by email, and any resulting sale, commission agreement, payment, shipping, or studio visit is arranged directly between you and the artist.
We do not verify the identity of buyers or artists, authenticate artworks, or guarantee pricing, condition, delivery, or completion of commissions. Exercise the same judgment you would in any private sale, and resolve any dispute directly with the other party. By sending an inquiry you consent to your email address being shared with the artist so they can reply to you.
7. Follows, Decks, and Sharing
You may follow artists and save works and artists to your deck. Decks have visibility settings; a deck you make public is viewable by anyone with the link and may be indexed and shared. Following an artist notifies that artist that you followed them.
8. Notifications and Email
The Service sends transactional email (such as account verification, password resets, and inquiry notifications) and, depending on your settings, digest emails about new work from artists you follow. You can change your digest frequency or unsubscribe from digests at any time in your settings or via the link included in every digest email. Transactional email necessary to operate your account cannot be disabled while your account is active.
9. Copyright Complaints
We respect the intellectual property rights of others and expect users to do the same. If you believe a work published on the Service infringes your copyright, contact us at the address listed on our GDPR page with the URL of the work, a description of the copyrighted material, and a statement that you own or are authorized to act for the owner of the rights. We will review complaints and remove infringing content, and we may terminate the accounts of repeat infringers.
10. Termination
We reserve the right to suspend or terminate your account, remove your content, or remove your listings from the map and other discovery surfaces at our discretion, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, us, or third parties.
11. Disclaimers
The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted or error-free. We make no warranties regarding any artist, artwork, listing, or transaction, including authenticity, quality, legality, safety, or accuracy of location information shown on the map.
12. Limitation of Liability
To the fullest extent permitted by law, ArtDeck shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Service, including any transaction, commission, communication, or in-person meeting between users arranged through the Service.
13. Governing Law
These Terms are governed by the laws of the United States, without regard to conflict of law provisions.
14. Changes
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
